So, for you called another perspective on obtaining Poles Card.
We can’t ensure a positive outcome, but you will be able to pass relatively complex tested way to change nationality.
The lawyer, Eugene Vahovskyy:
“In 2014, my legal advice on obtaining Maps client approached the Pole, who explained that her daughter from her first marriage well in school, studying the Polish language, is the winner of many regional competitions in Polish, wants to continue her education in high school in Poland. Therefore it was necessary for her daughter to get the Pole card, which authorizes the use of free education system at the primary, secondary and higher levels on the same terms as the Polish citizens, and at the same time to apply for assistance and scholarships intended for foreigners who are enrolled in Poland.
According to the Law of Poland “On the Polish Card” – Polish Card may be issued to a person who considers himself to the Polish people at the same time can prove that at least one parent (father or mother), grandfather or grandmother or great-grandfather and great-grandmother (both) were Polish nationality or were Polish citizens.
The problem that prevented the Pole to get the card for her daughter as follows:
From the mother’s side in the family Poles did not exist but the father’s parents were Polish, but mother and father have been divorced for a long time, the father abused alcohol, was deprived of parental rights, was not involved in his daughter education, often disappeared and no one knew how to find him. After consultation with the client decided to turn to a man who is a grandfather for the girl from the father’s side. He also was not engaged in raising a granddaughter, family ties are not supported and has l been retired for a long time. The problem was that it also in all the documents was recorded as Ukrainian, although his father (grandfather granddaughter) were recorded Pole and his mother Ukrainian. According to the Law of Poland “On the Polish Card” these documents are not enough for the Polish Card.
Therefore, it was decided to go to court on behalf of his grandfather’s granddaughter with a statement to change his nationality from Ukrainian to Polish. If these changes accepted it would allow her granddaughter to contact the Consulate of the Republic of Poland for the Polish Card. Grandfather agreed to provide a copy of his passport, his birth certificate and signed power of attorney to represent his interests in court. In the birth certificate stated that his father is Polish and his mother-Ukrainian. Archival information confirmed that the grandfather and grandmother of the man’s side were both Poles.
One way to prove their Polish origin is an appeal to the court to establish a legal fact and amendments to such registration. In parts of the registrar provides information on the nationality of citizens in the birth record and the record of marriage – and they needed to make changes. In this case, it was decided to amend the record of the first marriage where the husband changes the nationality column from Ukrainian onto Polish.
On behalf grandfather was written declaration to the appropriate department of civil registration request to amend the record of the marriage of a man changing nationality. Division registry office issued a statement on the conclusion of amendments to the record of civil status in which the applicant refused on the grounds that no record of civil status which confirmed Pole nationality.
Since the possibility of pre-trial adjustment of this issue has been exhausted, it was decided to apply to court to establish a legal fact and amendments to such registration. In its application, the applicant requested the Court to establish a legal fact that he belongs to the Polish nationality that nationality is Polish, and asked to oblige the department of civil registration amend the record of the marriage where the husband’s nationality column “Ukrainian” changed to “Pole “.
During the preparation of the application to the court found that there are some jurisprudence to address similar issues and relevant decisions taken by the courts in favor of the applicants. Therefore, this case was decided in his favor and the court fully upheld the declaration of legal fact and ordered the department of civil registration amend the record of the marriage of a man changing nationality.
